2. Definitions

• "Lead Data" means property-based marketing intelligence provided by HowdyNeighbor
• "Services" means the platform, data, analytics, exports, and APIs
• "User" means any licensee accessing the Services

3. License

HowdyNeighbor grants you a limited, non-exclusive, non-transferable, revocable license to use Lead Data solely for internal marketing and prospecting purposes.

4. Restrictions

You may not: use Lead Data for underwriting, pricing, eligibility, or insurability decisions; redistribute, sublicense, or resell Lead Data; or represent Lead Data as consumer reports.

5. Payment and Delivery

All purchases are final upon delivery. Delivery occurs at the moment Lead Data is made available for download or access.

6. Refund Policy

• Refunds may be requested within 30 days solely for verified data inaccuracies (invalid numbers, deceased, incorrect property)
• Marketing performance, conversion rates, or consumer response do not qualify for refunds
• Submit refund requests via your My Leads page or email support@howdyneighbor.io with order number and lead IDs

7. Consumer Reporting Act Disclaimer

HowdyNeighbor is not a consumer reporting agency and does not furnish consumer reports. Lead Data may not be used for any purpose governed by the Fair Credit Reporting Act.

8. Warranty Disclaimer

Services are provided "AS IS" without warranties of any kind, express or implied.

9. Limitation of Liability

HowdyNeighbor's total liability shall not exceed the amount paid by you in the prior 12 months.

10. Indemnification

You agree to indemnify HowdyNeighbor against any claims arising from your misuse of Lead Data or violation of these Terms.

11. Governing Law and Venue

These Terms are governed by Arizona law. Exclusive venue shall be Maricopa County, Arizona.

12. Severability and Assignment

If any provision is unenforceable, the remainder remains in effect. You may not assign these Terms without written consent.

13. Updates

Terms may be updated at any time and become effective upon posting.
